In brief: Wildly is an educational family app. Use it lawfully, supervise children appropriately, and remember that animal information and illustrations are provided for general educational and entertainment purposes.

These Terms of Service (“Terms”) govern your access to and use of the Wildly — Daily Animals mobile application, website, content, and related services (together, the “Services”). Wildly is operated from Spain (“Wildly”, “we”, “us”, or “our”).

By downloading, accessing, purchasing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you allow a child to use Wildly, you confirm that you are authorised to accept these Terms on the child’s behalf and that you will provide appropriate supervision.

1. Eligibility and family use

The Services are designed to be enjoyed by families, including children using the app with a parent, guardian, teacher, or other responsible adult. Purchases and subscription management must be completed by an adult or through an Apple account configured with the appropriate parental controls and purchase permissions.

You are responsible for the activity carried out through your device and Apple account and for ensuring that use of the Services complies with applicable age, family, school, and household rules.

2. Licence to use the Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to install and use the app for private, non-commercial purposes on Apple devices that you own or control, subject to the applicable App Store rules.

Wildly provides general educational and entertainment content about animals, habitats, conservation, biology, and related topics. The content is not professional scientific, veterinary, medical, legal, safety, wildlife-handling, or travel advice.

Animal behaviour can be unpredictable. Do not approach, touch, feed, capture, disturb, or handle wild animals based on information in the Services. Always follow local rules and the advice of qualified professionals, wildlife authorities, educators, and responsible adults.

We work to make the content accurate, age-appropriate, and useful, but scientific knowledge, conservation classifications, animal ranges, and other facts may change. We do not guarantee that every item is complete, current, or free from error.

4. AI-assisted and generated content

Some illustrations, images, descriptions, translations, or other creative materials in Wildly may be generated or assisted by artificial intelligence tools. Such materials may be selected, edited, translated, reviewed, or combined with human-created work before publication.

AI-generated animal illustrations are artistic or educational representations and should not be treated as photographs, exact anatomical references, or definitive records of appearance, scale, behaviour, habitat, or geography. Despite review and quality controls, AI-assisted material may contain visual or factual inaccuracies.

Where appropriate, we may provide additional labels or disclosures inside the app, on the website, in credits, or alongside particular content.

5. Availability and daily content

The Services may present animals according to a daily schedule, calendar, subscription tier, release plan, region, language, device, or app version. We may add, remove, replace, reorder, correct, or update animals, images, descriptions, quizzes, videos, features, and schedules.

References to a number of animals, days, biomes, collections, or features describe the intended product experience and may vary because of leap years, technical limitations, content updates, regional availability, or product changes.

We do not guarantee uninterrupted access to any particular animal, media item, external video, online feature, or part of the Services.

6. Free access, trials, and subscriptions

Wildly may offer free access, limited access, promotional access, free trials, subscriptions, lifetime purchases, supporter plans, or other in-app purchases. The features and limits of each option are displayed in the app or on the App Store before purchase and may differ by country, storefront, promotion, or release period.

Billing

Purchases are processed by Apple through the App Store and are charged to your Apple account. Prices, taxes, billing currency, and payment methods are determined or displayed by Apple. We do not receive your full payment-card details.

Automatic renewal

Unless stated otherwise at purchase, subscriptions automatically renew for the same subscription period until cancelled. Apple may charge your account within the period shown in the App Store subscription terms before renewal.

Free trials and promotions

Where a free trial or promotional period is offered, eligibility may be determined by Apple, Wildly, or our subscription provider. Unless cancelled before the trial ends, the trial may convert into a paid subscription at the price displayed when you subscribed. Reinstalling the app does not necessarily restore eligibility for another trial.

Cancellation

You can manage or cancel a subscription through your Apple account’s subscription settings. Deleting the app does not cancel a subscription. Cancellation normally takes effect at the end of the current billing period, subject to Apple’s applicable rules.

Refunds

Refund requests and billing disputes for App Store purchases are handled by Apple under Apple’s policies and applicable consumer law. Wildly cannot directly issue refunds for transactions processed by Apple unless the relevant platform process permits it.

Price and plan changes

We may change the price, composition, or availability of plans and features. Any subscription price increase will be handled through the notices, consent requirements, and procedures required by Apple and applicable law.

7. Progress, access, and restoration

The app may store progress, discoveries, streaks, quiz outcomes, preferences, and entitlement information locally or through cloud services. We aim to preserve this information but do not guarantee that progress will never be lost, delayed, duplicated, or reset.

Premium access may depend on Apple receipt information, RevenueCat entitlement information, network availability, and the Apple account used for purchase. Purchase restoration is subject to successful validation and the rules of the applicable platform.

8. Notifications and external services

Optional notifications may remind you about daily content, progress, or service information. Delivery is not guaranteed and depends on device settings, operating-system behaviour, network conditions, and third-party notification services.

The Services may contain links to third-party websites, videos, maps, platforms, or media. We do not control those services and are not responsible for their availability, content, privacy practices, advertising, or terms. Use of third-party services is governed by their own terms and policies.

9. Intellectual property

The Services, including their software, design, branding, logos, illustrations, text, translations, audio, animations, selection and arrangement of content, and other materials, are owned by or licensed to Wildly and are protected by intellectual-property laws.

“Wildly”, “Daily Animals”, associated logos, and the visual identity of the Services may not be used without prior written permission, except where applicable law permits nominative use. No ownership rights are transferred to you under these Terms.

10. Feedback

If you send us suggestions, ideas, corrections, or other feedback, you permit us to use, adapt, and incorporate that feedback without restriction or compensation, provided that we do not publicly identify you without permission.

11. Privacy

Our handling of personal data is described in our Privacy Policy. By using the Services, you acknowledge that data may be processed as described there.

12. Suspension and termination

We may restrict or terminate access to the Services where reasonably necessary to protect users, enforce these Terms, comply with law, prevent fraud or abuse, address security risks, or protect the operation and rights of Wildly and others.

You may stop using the Services at any time. Stopping use or deleting the app does not automatically cancel subscriptions, erase all server-side data, or create a right to a refund.

13. Changes to the Services

We may modify, suspend, replace, or discontinue all or part of the Services, including content, free-access rules, discovery limits, subscriptions, supported languages, device compatibility, and online features. Where required by consumer law, we will provide reasonable notice of material changes that negatively affect an ongoing paid service.

14. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available”. We do not warrant that they will always be uninterrupted, secure, error-free, compatible with every device, or that all content will be complete or current.

Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded under applicable consumer law.

15. Limitation of liability

To the maximum extent permitted by law, Wildly will not be liable for indirect, incidental, special, consequential, or purely economic losses arising from use of or inability to use the Services, loss of progress, reliance on educational content, third-party services, or unauthorised access beyond our reasonable control.

Where liability cannot be excluded, our liability will be limited only to the extent permitted by applicable law. These limitations do not apply to liability that cannot legally be limited, including where applicable for fraud, deliberate misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

16. Indemnity

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses arising from your unlawful use of the Services, deliberate violation of these Terms, or infringement of another person’s rights. This section does not apply where prohibited by consumer law.

17. Apple-specific terms

These Terms are between you and Wildly, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for the app.

Your use of the app must comply with the App Store Usage Rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you. To the extent required, Apple’s applicable standard end-user licence terms also apply.

If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price paid for the app, if any, to the extent required by Apple’s rules and applicable law. Apple has no other warranty obligation for the app to the maximum extent permitted by law.

18. Governing law and disputes

These Terms are governed by the laws of Spain, without depriving consumers of mandatory protections provided by the law of their country of residence. Courts will have jurisdiction as determined by applicable consumer and procedural law.

Before starting formal proceedings, you are encouraged to contact us so that we can try to resolve the issue informally. Nothing in this section limits your right to contact a consumer protection authority or use another remedy available under applicable law.

19. Changes to these Terms

We may update these Terms when the Services, business model, providers, or legal requirements change. We will publish the revised Terms and update the effective date. Where required, we will give additional notice or request renewed acceptance.

20. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. We may assign these Terms in connection with a merger, acquisition, reorganization, or transfer of the Services, subject to applicable law. You may not transfer your rights under these Terms without our permission.
